Terms and Conditions of Sale

1. Company Information

These terms and conditions govern all sales made through the Towa online store at towagear.com, operated by TOWA GEAR, a French Simplified Joint-Stock Company (SAS) with a share capital of €1,000, registered with the Paris Trade and Companies Register (RCS) under SIREN number 109 058 784, with its registered office at 47 Rue Vivienne, 75002 Paris, France.

2. Products

Towa Gear sells modular finger straps designed for grip sports (BJJ, grappling, climbing, rugby). Products are presented on the site with descriptions and visuals that are as accurate as possible. Minor variations may occur, particularly due to the 3D printing manufacturing process.

3. Prices

All prices are displayed in euros, inclusive of applicable French VAT. Towa Gear reserves the right to modify its prices at any time; the price applicable is the one in effect at the time the order is confirmed. Shipping costs are calculated at checkout and displayed before order confirmation.

4. Orders

Orders are confirmed by email upon successful payment. Towa Gear reserves the right to cancel any order in the event of stock unavailability or payment issues.

5. Payment

Payment is due immediately upon ordering. Payments are securely processed via the payment solutions integrated into the Shopify platform.

6. Delivery

Products are shipped to the address provided by the customer at checkout. Estimated delivery times are indicative and may vary depending on the destination. A tracking number is emailed once the order has shipped.

Towa Gear cannot be held liable for delays caused by the carrier or events beyond its reasonable control.

7. Right of Withdrawal

In accordance with applicable EU distance selling regulations, the customer has a period of 14 calendar days from receipt of the product to exercise their right of withdrawal, without needing to provide a reason or pay a penalty.

To exercise this right, the customer must notify their decision in writing to contact@towagear.com. The product must be returned in its original condition, unused, and in its original packaging where possible.

Refunds will be issued within 14 days of receiving the returned product, using the same payment method as the original transaction, unless otherwise agreed.

Return shipping costs are the responsibility of the customer, unless otherwise stated on the site.

8. Warranties

Products sold by Towa Gear benefit from legal warranties applicable in France and the European Union, including the legal warranty of conformity and the warranty against hidden defects.

9. Liability

Towa Gear products are designed as supplementary protective equipment for grappling sports practice. They do not replace medical advice or a certified medical device. The user remains solely responsible for the appropriate use of the product in relation to their practice and health condition.

10. Personal Data

The processing of personal data collected as part of orders is carried out in accordance with our Privacy Policy and applicable data protection law (GDPR).

11. Governing Law and Disputes

These terms and conditions are governed by French law. In the event of a dispute, an amicable solution will be sought before any legal action. Failing an amicable agreement, French courts shall have exclusive jurisdiction.
